Simplification of Property Rights Settlement Necessary for Preparation of Structures That Constitute Significant Investments

Pursuant to the law, a structure whose construction is to be provided for by a legal person having its registered seat in the territory of the Slovak Republic shall be considered a Significant Investment provided that:

  1. funds needed for realization of such a structure amount to at least EUR 100 million of investment costs;
  2. such a structure is of national economic importance, or realization of or carrying out such a structure will create at least 300 new jobs, and
  3. the Government of the Slovak Republic decided in respect of such a structure that realization thereof is in public interest.

In accordance with the law, a structure whose construction is to be provided for by a business that does not meet the requirements under a) and b) shall also be considered a Significant Investment provided that:

  1. realization of such a structure is necessary for ensuring operation of activities within the Significant Investment to which it relates technically, technologically or logically, and
  2. the Government decided in respect of such a structure that realization thereof is in public interest.

For structures constituting Significant Investments to be carried out, land and buildings can be expropriated in the public interest or the ownership of land and buildings can be restricted by means of a decision of a building authority. By expropriation the ownership of land and buildings passes to the applicant. By expropriation any other rights concerning the expropriated land and buildings cease to exist unless otherwise stipulated in the decision.
